What happens when you get into an accident with a driver who has no auto insurance coverage? Will I get this benefit even if I do not have uninsured drivers coverage?
Response :As a college studnet I understand the need to having very cheap auto insurance rates and still wanting the best auto insurance coverages. Let me inform you that presently in the USA one driver out of every six driver is uninsured. Hence presently, this is one of the compelling reasons why you need to have auto insurance coverage and besides this you need an uninsured driver or underinsured drivers coverage. The main reason for insurance is to help you not getting into financial problems. If you do not have the best car insurance coverages than the very purpose of auto insurance would be defeated when something unwanted happens.
The underinsured or uninsured drivers car insurance coverage is not mandatory in all states of the USA. It is a coverage which is priced very low and hence it is safer to have it than not have it at this juncture when there is a large amount of people who are driving the highways and by ways of USA without insurance. .
Here are a scenario about what happens when an insured driver collides with an uninsured or underinsured driver:
• Uninsured driver – If your car collides with an uninsured driver and he or she is at fault, than your uninsured drivers coverage will pay for the repairs of your car and also any injury that you or any passengers in your car sustain. The only part is that your insurance company should conclude that you were not at fault. This is not so much of a problem since the traffic rules and deciding who is at fault is already laid down as per the traffic guidelines and the insurance regulations which the insurance companies have to abide to. You will need to get as much information from the driver and relay it to your insurance company. Depending on who is at fault and what was damaged, your insurance company will reimburse the damage to your car but probably at the expense of your premiums. The main thing to focus here is that this would not be considered a claim under your policy for underwriting purpose and so your insurance premium will not shoot up in the subsequent year. You will want to consider a lawsuit against the uninsured driver in this case or if your insurance company agrees they would pay you and you will subrogate the rights against the uninsured driver to them. In the question of underinsured driver it is the same case as above. What you need to consider is that you would be a winner in either situation if an accident happens.

Presently in Michigan the debate is heating up between the lawmakers and the insurance companies. The
Democratic lawmakers in Michigan are promoting proposals they say would make auto insurance more affordable and strengthen consumer protections in the state. The insurance industry and the opposition is trying to stop this and says that this would lead to elections, according to Associated Press reports.

The Democratic proposals would require that companies get prior approval from the state insurance commissioner before raising rates. A driver’s education level or credit history could not be used as factors in determining rates.

The proposed initiative would allow Michigan voters to weigh in on consumer-oriented insurance reforms that have saved California drivers an average of $3 billion per year since being enacted in 1988, according to consumer advocacy groups Consumer Watchdog and Consumer Federation of America (CFA).

Those groups said a 2008 CFA study that reviewed insurance regulations around the country and determined that the California system, on which the Fair Affordable Insurance Rates (FAIR) proposal is based. This has been the most effective law in the nation in creating an auto insurance market that is competitive, has low rates and protects consumers from abusive insurer practices.

They maintain that auto insurance rates in Michigan are around 12 percent higher than the national average. The proposal, according to the consumer advocacy groups, would reduce rates in Michigan by 20 percent. It would require insurers to base rates primarily on a motorist’s driving record rather than factors like their ZIP code or marital status, which currently dominate the pricing structure of many insurers.

The insurance companies are objecting to this, however, the reality is that the market is shifting in favour of the consumers and they will ultimaltey benefit and get cheap auto insurance quotes. It is also time the consumers were favoured.
